UP Rera's New Mandate on Project Land Ownership For Promoter

UP Rera has directed all the promoters to prove their ownership of the project land where the project will be developing. According to Rera authority, the UP RERA rules specify that to transfer the ownership to the buyer from the developer, it is mandatory to prove the ownership of the project land; otherwise, it is not legally possible to transfer the ownership. Some promoters are overlooking this provision and developing projects on the land that is legally entitled to some other person. In that case, promoters are directed either to prove the ownership or the consent of the owner along with a Joint Development Agreement (JDA) with him.

The authority also directed the promoters to file an affidavit to prove that land is free from all the encumbrances and if there is any encumbrance, then to disclose it. UP RERA has issued this notice to ensure the protection of the rights of the consumers and to facilitate the conveyance deed in their favour without any legal hindrances.
