Recently, in July 2025, the Uttar Pradesh Government announced a 1 percent exemption on stamp duty for women if their property value is below or equal to 1 crore. But there are several doubts among homebuyers regarding this policy.
Homebuyers ask: What if the property exceeds 1 crore, will they still get the benefit? What happens in jointly owned properties? How will the exemption be calculated? What types of properties are covered under this policy?
There are many such questions. But today in this blog, we will clear all your doubts and explain this policy in the simplest and easiest language possible.
What is this new stamp duty exemption policy?
Under this new stamp duty exemption policy, the UP Government has announced a 1% stamp duty exemption for women if the property value is up to 1 crore.
Earlier, this benefit was only applicable to properties worth up to 10 lakh, meaning the maximum discount was just 10,000.
But now, with the increased limit of 1 crore, women can save up to 1 lakh in stamp duty. However, the policy is vague and has caused confusion due to lack of clarity about how, when, and where it applies, which we are here to simplify.
What kind of properties does this policy apply to?
This policy applies to all types of properties in Uttar Pradesh—residential, commercial, and land, but only if a woman is an owner. That’s the only key condition to qualify for this exemption.
There are many misconceptions surrounding the policy. But nothing else has changed except the maximum value limit. All other rules and conditions remain the same as before.
What if the property is jointly owned by a man and a woman?
If a property is jointly owned by a man and a woman, then the woman must declare her share at the time of property registration.
Example: Suppose the property cost is 2 crore and both man and woman own 50% each.
Then, the woman is eligible for exemption only on her 1 crore share.
1% of 1 crore = 1 lakh exemption.
So, she pays 4% stamp duty on her 1 crore share (i.e., 4 lakh).
The remaining 50% share (held by the man) does not qualify for exemption and will attract the full 5% stamp duty (i.e., 5 lakh).
What if the property value exceeds 1 crore?
Many buyers believe that if the property value exceeds 1 crore, they will not be eligible for any exemption. But that is not true.
This works like a tax slab system. You can still claim 1% exemption on the first 1 crore, and the remaining amount will be charged at the standard stamp duty rate.
Example: Let’s say you purchase a property worth 1.5 crore.
1% exemption is allowed on 1 crore, which equals 1 lakh.
Stamp duty in UP is 5%, so 5% of 1 crore = 5 lakh → With exemption, you pay only 4 lakh.
Remaining 50 lakh is taxed at 5% = 2.5 lakh.
Total Stamp Duty = 4 lakh + 2.5 lakh = 6.5 lakh
So even if the property costs more than 1 crore, you can still save up to 1 lakh.
What if the property value is less than 1 crore?
If your property is less than 1 crore, say 75 lakh, then:
• You can claim 1% exemption on 75 lakh.
• 1% of 75 lakh = 75,000 (not 1 lakh).
• Normal stamp duty @5% = 3.75 lakh.
• After exemption, you pay only 3 lakh.
So, the exemption is calculated as 1% of the property value, not a flat 1 lakh.
How will the property share be divided?
In case of joint ownership, the share of each co-owner must be declared at the time of registration.
• If only one woman is a co-owner, she will get exemption only on her share.
• If two women co-own the property, they can share the 1% exemption.
Note: Every woman will not get a separate 1% exemption. The 1% exemption is for the total property value up to 1 crore, not per person.
